1. Agreement to Terms
By accessing or using NCLEX Lab (the "Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.
2. Account Registration
To use certain features of the Service, you must register for an account. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.
3. Subscription and Billing
- Billing Cycle: The Service is billed on a subscription basis. You will be billed in advance on a recurring, periodic basis.
- Cancellation: You may cancel your subscription at any time. Your access will remain active until the end of your current billing period.
- Refunds: Pro and Ultimate plans come with a 94% Pass Guarantee. If you fail the NCLEX within 90 days of completing the required modules, we will refund your last subscription payment. Normal subscriptions are generally non-refundable.
4. Content and Intellectual Property
The Service and its original content (including questions, rationales, and AI-generated text), features, and functionality are and will remain the exclusive property of NCLEX Lab and its licensors. The Service is protected by copyright, trademark, and other laws. You may not copy, distribute, or create derivative works from our content without explicit permission.
5. Prohibited Use
You agree not to use the Service:
- In any way that violates any applicable national or international law or regulation.
- To share your account credentials with multiple users (account sharing is strictly prohibited).
- To scrape, data-mine, or automatically extract question content from our databases.
- To attempt to circumvent any restrictions or security measures of the Service.
6. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
7. Limitation of Liability
In no event shall NCLEX Lab, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect.
